Q. When can merchants begin surcharging credit cards?

          A.  January 27, 2013


Q. Can a merchant assess a surcharge on a debit or prepaid card?           

          A.  No. The ability to surcharge only applies to credit card purchases, and only under certain conditions. U.S. merchants cannot surcharge debit card or prepaid card purchases.


Q. Can a merchant assess a surcharge on debit card transactions for which the cardholder using a debit card chooses “credit” on the point of sale terminal?

           A. No. The ability to surcharge only applies to purchases made with a credit card, and only under certain conditions.


Q. Can a surcharge be assessed as a separate transaction?

           A. No, in order to surcharge the fee must be disclosed as a surcharge on the receipt and must be in the same transaction as the purchase. The merchant must also notify customers of surcharging at the store entrance and at the point of sale. In an online environment, it must be disclosed on the first page that references credit card brands.
